Complex Bankruptcy Litigation

Mr. Geller has litigated a wide variety of bankruptcy matters, including actions to avoid and recover fraudulent conveyances and preferential transfers, actions for breach of fiduciary duties, contested cash collateral motions, stay relief motions, motions to dismiss and/or convert, motions to appoint Chapter 11 trustees, and contested confirmation hearings. Mr. Geller has a particular expertise in cases involving complex valuation issues and valuation experts.

Complex Commercial Litigation

In addition to his bankruptcy-specific litigation, Mr. Geller has represented both plaintiffs and defendants in complex commercial litigation in federal and state courts. The claims have run the gamut from breach of contract claims, to breach of fiduciary duty claims, to lender liability claims, to compelled corporate dissolution claims, to tax accounting claims.

Corporate Chapter 11 Reorganizations

Unlike many firms that specialize in representing one type of party in Chapter 11 cases, Mr. Geller has been exposed to all sides of the equation, representing debtors, secured and unsecured creditors, creditors committees, Chapter 11 trustees, and liquidating trustees in cases of regional and national significance.

Bankruptcy and Commercial Mediation

As litigation has become more complex and expensive over the past 10-20 years (in part due to the ever-expanding scope of electronic discovery), Mr. Geller perceived a growing need for mediators having bankruptcy expertise. To meet that need, Mr. Geller completed the American Bankruptcy Institute/St. John’s University 40-hour bankruptcy mediation  training program in December 2013. Now, in addition to representing parties in mediations, Mr. Geller is positioned to serve as a neutral mediator and to assist parties in resolving their disputes in a more economical setting.

Out-of-Court Workouts

Mr. Geller has represented both borrowers and lenders in dozens of out-of-court workouts over his 35+-year career.
